These terms always apply to Refurbly Flex rental of mobile phones and tablets (the “Service”) to consumer customers, and to business customers unless otherwise stated at the time of order. Refurbly Asset Holding AB is the lessor, owner of the Device and payment recipient. Refurbly AB administers the Service, customer support, delivery, warranty, insurance handling and other practical administration on behalf of Refurbly Asset Holding AB.

By signing up for the Refurbly Flex service, you accept and are bound by the terms in this document. Please read through and make sure you understand these terms before signing up for the Service.

1. Definitions

“Refurbly” or “Refurbly AB” refers to Refurbly AB (registration number 559160-2890, address Nygatan 29, 702 11 Örebro, Sweden), the company that markets, administers and provides customer support, delivery, warranty, returns handling and other practical administration of the Service on behalf of Refurbly Asset Holding AB.“Refurbly Asset Holding AB” refers to Refurbly Asset Holding AB (registration number 559588-9568), the company that is the lessor, owner of the Device, contracting party with the customer and recipient of monthly fees under Refurbly Flex.“You”, “Your” or “customer” refers to the natural or legal person who registers for the Service and enters into a rental agreement with Refurbly Asset Holding AB. Refurbly AB may handle the agreement, support and administration on behalf of Refurbly Asset Holding AB.“Terms” or “Agreement” refers to the rules, obligations and rights stated on this page that govern use of the Service.“The Service” refers to the subscription service Refurbly Flex, which customers can use to subscribe to mobile phones and tablets, including associated warranties and protection. The Device is owned by and rented out by Refurbly Asset Holding AB.Refurbly AB administers the Service on behalf of Refurbly Asset Holding AB. This includes, among other things, customer service, communication with the customer, receipt of messages, order handling, delivery, returns handling, warranty and insurance administration, payment administration and other practical administration required to fulfil this agreement.“Subscription” or “Rental” mean the same thing in these terms: your right to use a device for a certain period against a recurring fee. In marketing and communication the term “Subscription” is used, while the legal meaning is that it is a rental where ownership always remains with Refurbly Asset Holding AB, or another financing party if the customer is informed of this.“Device” or “the Device” refers to a mobile phone, tablet or computer owned and rented out by Refurbly Asset Holding AB and practically provided by Refurbly AB. Depending on your choice at order, the Device may be either new or refurbished.“Refurbly Warranty” refers to the commercial warranty provided by Refurbly on behalf of Refurbly Asset Holding AB, unless otherwise stated.“Insurance” refers to Refurbly Care, an accidental damage insurance covering damage, theft or loss of the device during the rental period.“Protection” refers to the damage and loss protection included in Refurbly Flex. Protection may be provided either through the Refurbly Care insurance in cooperation with an external insurer or directly by Refurbly AB and/or Refurbly Asset Holding AB, depending on which party administers the claim. The scope of protection is set out in these terms.“Day” means a business day. Weekends and public holidays do not count as business days.“FMI” refers to the Find My iPhone feature on Apple iPhone devices, which must be deactivated before returning the mobile phone.“IMEI” refers to the unique international identity for mobile equipment used to identify individual devices.“Promotional price” refers to a time-limited discounted price for the Service that applies under special terms.“Reasonable market price” refers to the price determined by Refurbly Asset Holding AB based on the value of an equivalent device at the relevant time.

2. Customer

By registering for the Service, you accept and are bound by these Terms. You are required to provide your complete contact details when signing up for the Service, including your name, billing and delivery address, active phone number and email address. You are solely responsible for the accuracy of the information you provide to Refurbly AB and Refurbly Asset Holding AB, and are liable for all costs caused by providing incorrect contact details.By registering for the Service, you confirm that you have reached the age of majority to be bound by these terms and sign up for the Service.Customer data is processed by Refurbly AB and Refurbly Asset Holding AB to the extent required to administer the Service, payment, credit checks, insurance, warranty, returns and claims handling. More information on the processing of personal data is available in Refurbly's privacy policy, which is available on Refurbly's website.

3. The rental service

Refurbly Flex is a subscription service from Refurbly Asset Holding AB, administered by Refurbly AB, which customers can use to subscribe to mobile phones, tablets and computers for a defined period. Devices are inspected and refurbished by Refurbly's experts before being made available on the Service. Refurbly AB grades devices based on cosmetic condition. When you register for the Service, you choose the desired model, colour, storage capacity and cosmetic condition of the device you wish to subscribe to.

Buyout of device during ongoing contract period

If you wish to buy out the device before your contract period ends, this is done at the device's current reasonable market price according to Refurbly Asset Holding AB's valuation, which may be administered by Refurbly AB. Your monthly payments are not deducted from the price as they relate to the service (use, warranty, insurance, etc.) and should not be regarded as instalment payments on the device. An administrative fee applies upon buyout. After payment, ownership transfers to you and the subscription protection and warranty cease immediately. Buyout requires separate confirmation from Refurbly Asset Holding AB or Refurbly AB on its behalf.

Buyout of device after end of contract period

If you wish to buy out the device after your initial contract period has expired, this is also done at the current market price according to Refurbly Asset Holding AB's valuation, which may be administered by Refurbly AB. In this case, Refurbly Asset Holding AB, or Refurbly on its behalf, offers a discounted price compared to market value. The discount varies between different models and is determined by Refurbly Asset Holding AB or Refurbly based on the device's type, age and condition. For pricing information, contact Refurbly customer service. Note that prices provided are indicative and only become binding once a buyout order has been confirmed.

Device condition and description

The mobile phones and tablets rented through the Service may be either used or brand new. All used devices are inspected, tested and refurbished, but Refurbly AB and Refurbly Asset Holding AB do not guarantee that the product's original resistance to splashes, dust and water (IP certification) still applies. Brand new devices are in their original condition and are covered by the product's original specifications.We make all reasonable efforts to accurately describe the properties of our products, including condition and colours.

4. Ownership of the device

The Device is owned by Refurbly Asset Holding AB throughout the rental period, unless the customer is informed in writing that ownership has transferred to another financing party.If this occurs, you as customer will be informed, but it does not affect your subscription, your rights or your obligations in any way. You pay the monthly fee to Refurbly Asset Holding AB, or to the payment recipient stated in the payment flow.Note that the device you subscribe to may be bought out from Refurbly Asset Holding AB, or from Refurbly AB on behalf of Refurbly Asset Holding AB, after the subscription agreement ends, based on the current market price of the device. To complete a buyout, please contact our customer service.

5. Prohibition on transfer or sub-letting

The Device provided through Refurbly Flex is always the property of Refurbly Asset Holding AB or another stated owner. You may therefore not sell, pledge, give away, rent out or otherwise transfer the device to a third party.You may allow close family members to use the device, but you as contracting party are always responsible to Refurbly Asset Holding AB for the device and for compliance with the terms of this agreement.Breach of this prohibition is considered a material breach of contract and gives Refurbly Asset Holding AB the right, directly or through Refurbly AB, to immediately terminate the service, require return of the device and charge any costs incurred, including compensation equivalent to the device's reasonable market price if the device is not returned.

6. Rental period

Once you have chosen your desired device and approved the price, the first monthly fee is charged by Refurbly Asset Holding AB via Stripe or another payment provider. The name shown on your bank statement may be Refurbly, Refurbly Flex, Refurbly Asset Holding AB or another clearly stated payment description. The phone is shipped to you after the first payment has been completed and you have passed a credit check by Refurbly AB and/or Refurbly Asset Holding AB, or by their credit partner.The rental period is counted from the date you register for the service. The rental period ends when the Device has been returned to and received by Refurbly AB on behalf of Refurbly Asset Holding AB. Delivery and return days are included in the rental period unless otherwise agreed.After the initial contract period of 12 months, you may choose one of the following:
a) continue using the service with the same phone at an unchanged monthly fee,
b) upgrade to a newer model by contacting Refurbly customer service,
c) terminate the service
d) buy out the device.If you choose to switch to another device after 12 months, you must order the swap through Refurbly. Refurbly will then send the new Device to you. Once you have received the phone, you have 14 days to sync the phones and return the Device according to instructions from Refurbly AB on behalf of Refurbly Asset Holding AB. If the phone is not sent to Refurbly within 14 days, Refurbly Asset Holding AB will continue to charge you the monthly fee for the old device. If this fee is not paid, the terms specified under section 9 regarding “Payment” in these terms apply.

7. Terminating the service

Refurbly Flex has a minimum commitment period (usually 12 months, in some cases 24 or 36 months) counted from the delivery date. During this period, the service cannot be terminated early, except in two situations: (i) if you exercise your right to a 30-day open purchase period, or (ii) if you choose to buy out the device at the current market price under the applicable buyout terms.Once the commitment period has expired, you may terminate the Service at any time by contacting Refurbly AB customer service, which handles termination on behalf of Refurbly Asset Holding AB. After notifying us that you wish to terminate the Service, you have 14 days to return the device to Refurbly using the shipping label provided. The Service is considered terminated when Refurbly AB, on behalf of Refurbly Asset Holding AB, has received, identified and processed the Device.If you do not return the device to Refurbly AB within 14 days after notifying us that you wish to terminate the Service, Refurbly Asset Holding AB will continue to charge you for the Service.

Termination before delivery or within open purchase period

If you cancel the Service before the product has been shipped to you, a refund of the first month's rental will be made to you. Refurbly Asset Holding AB will issue a refund using the same payment method used for payment as soon as possible and no later than 10 business days after notice of termination is received. In some cases, for example during public holidays or for other reasons, the refund may take longer. If Refurbly Asset Holding AB cannot issue a refund using the same payment method used for payment, the refund will be made using an alternative method acceptable to you. Administrative handling of returns and refunds is carried out by Refurbly AB on behalf of Refurbly Asset Holding AB.In addition to any statutory right of withdrawal, Refurbly Asset Holding AB offers a 30-day open purchase period from when you receive the product. To exercise open purchase, the device must be returned to Refurbly AB in the same condition as at delivery. After Refurbly has received and inspected the device, the amount is refunded under the same terms as above. If there are deviations from the original condition, Refurbly Asset Holding AB reserves the right to deduct a reasonable fee for depreciation before refund from Refurbly Asset Holding AB is made.

Obligations when returning the device

You must return the device in the same condition as you received it, except for normal wear. Normal wear does not incur any extra cost.The protection included in Refurbly Flex covers both damage and loss, including cases where the device is lost or so damaged that it is deemed a total loss. This means that in most cases you only pay a deductible of SEK 299, even if the device breaks or is lost.However, the insurance does not apply if the damage or loss was caused intentionally, through gross negligence, fraud, embezzlement or similar conduct. It also does not apply to minor scratches or normal wear, damage covered by warranty or statutory rights, or damage arising from force majeure events such as war, terrorism or riot. The insurance only applies during an active insurance period and requires that your payments for the service are up to date.If the device is damaged or lost under circumstances where the insurance does not apply, Refurbly Asset Holding AB has the right to charge you the device's reasonable market price.To return your device, complete the return form included in the package at delivery or sent to you by Refurbly customer service. You must ensure that Find My iPhone (FMI) has been deactivated before sending it to Refurbly AB. If FMI is enabled when Refurbly AB receives the device, we reserve the right to charge additional delivery fees and/or service costs. The return process may also be delayed because FMI is enabled.Before returning the device, you are obliged to back up and save any data you wish to keep. You must then erase all content and settings (factory reset the device). Refurbly AB erases all remaining data upon receipt and is not liable for any loss of data in connection with reset, repair or other handling of the device.You are responsible for packing the device carefully before sending it back. The device must be sent to us at the address and via the delivery service and in the manner stated in the instructions. You are responsible for the device until it has been delivered to Refurbly AB.

8. Prices

Prices for subscribing to a Device are stated on Refurbly AB's website and refer to rental from Refurbly Asset Holding AB. These prices refer to the monthly fee for the model and rental period selected. Product prices include value added tax (VAT) where applicable. In addition to the rental price, additional costs may apply depending on delivery method, the service selected and any add-on products. These are shown before you confirm the order.Refurbly Asset Holding AB has the right to adjust the rental fee for an upcoming contract period. You will be informed of this at least 30 days before the change takes effect. If the customer does not agree to the change, they may choose to terminate the contract before the new price takes effect. If no notice of termination is received, the customer is deemed to have accepted the price change. Refurbly AB will, on behalf of Refurbly Asset Holding AB, separately inform the customer of the option to terminate and the deadline for this before the new price takes effect.Refurbly AB, on behalf of Refurbly Asset Holding AB, reserves the right to cancel a rental order in the event of a clear and material pricing error. This refers to a possible pricing error where the price of the rental service deviates so materially and clearly from the service's normal price level that the average consumer could be assumed to have understood the error in question.

What applies to promotional prices

When signing up for a subscription at a promotional price, the specific terms and time period stated in the promotion apply. If the customer chooses to upgrade the device after 12 months – which Refurbly Flex provides at no additional service cost – the original promotional price ceases to apply. From the time of upgrade, the regular subscription price applies.

9. Payment

Refurbly Asset Holding AB accepts the following payment methods for private individuals when ordering via the Refurbly Flex website:

  • Card payment via Stripe with automatic recurring monthly charges from the payment card registered by the customer at order.
For business customers or orders placed through partners or outside the regular ordering flow on the Refurbly Flex website, other payment methods, such as monthly invoicing, may be offered by special agreement.All payments under this agreement are made to Refurbly Asset Holding AB. Payment administration, customer service and practical handling of payments may be carried out by Refurbly AB or by a payment provider engaged by Refurbly Asset Holding AB.It is your responsibility as customer to ensure that valid and up-to-date payment details are registered throughout the contract period. You must update your registered payment card via My account when the card expires or if it can no longer be used for any other reason.For each monthly payment, our system makes several automatic attempts to charge the fee before it is marked as unpaid. Failure to pay after these attempts constitutes a material breach of contract.

In case of non-payment

In case of unpaid fees, Refurbly Asset Holding AB has the right, directly or through Refurbly AB, to immediately suspend the service, block or revoke access to the device and require you to return it immediately. If the device is not returned within the prescribed time, this is considered unlawful possession of Refurbly Asset Holding AB's property and may result in a police report and a claim for compensation equivalent to the device's reasonable market price.Refurbly Asset Holding AB's claims regarding unpaid monthly fees, charges, compensation claims and the value of the Device may be referred to debt collection for recovery. The debt collection process may cover both outstanding monthly fees and the value of the phone. A debt collection case may result in additional costs, credit remarks and other negative financial consequences for you as customer.

10. Delivery

The current list of delivery methods is available on the Refurbly Flex website. You are responsible for providing Refurbly AB and/or Refurbly Asset Holding AB and the carrier with correct information for successful delivery when placing your order, including your address and your phone number in the correct format.If delivery fails due to incorrect or incomplete information you have provided, or if the shipment is not collected within the carrier's stated timeframe and is therefore returned to Refurbly AB, Refurbly Asset Holding AB has the right to charge you for the extra costs incurred. This includes but is not limited to return freight, handling and new shipping costs for redelivery. Such costs are charged automatically from the payment card you registered at order.

Processing & delivery times

Order processing time is normally 1 business day from when the order has been confirmed and any credit check has been approved. Delivery time is usually 1–3 business days. Order handling, warehousing and delivery may be carried out by Refurbly AB or by a third party engaged by Refurbly Asset Holding AB or Refurbly AB.Stated delivery times are estimates and depend on the carrier and any third-party logistics partner (3PL). Refurbly AB and Refurbly Asset Holding AB have the right to engage external logistics, warehousing and distribution partners to fulfil delivery, returns handling, warehousing and other logistics under this agreement. The customer may not object to such third parties being used, provided this does not affect the customer's rights under this agreement or mandatory law.However, Refurbly AB and Refurbly Asset Holding AB are not liable for delivery delays beyond our reasonable control, including but not limited to incorrect information from you when placing the order, strikes, weather conditions, pandemics, quarantines or shortages of transport fuel, energy or labour.If you receive an incorrect or transport-damaged product, this must be reported to Refurbly AB's customer service within 72 hours of delivery together with photographs showing the damage. If the report is made later than 72 hours, Refurbly Asset Holding AB assumes the damage occurred after delivery, unless otherwise required by mandatory law.If it is established that the product was incorrect or damaged at delivery, Refurbly Asset Holding AB is responsible for return freight and remedy or redelivery at no cost to the customer. If the investigation shows that the damage occurred after delivery or that it is not covered by warranty, statutory rights or the protection included in the Service, Refurbly AB and/or Refurbly Asset Holding AB have the right to charge the customer under applicable terms.Refurbly AB and Refurbly Asset Holding AB have the right to engage subcontractors to fulfil their obligations under this agreement. Such subcontractors may provide warehousing, order handling, logistics, delivery, repair, returns handling, payment administration and other administrative services. Engaging a subcontractor does not affect the customer's rights or Refurbly Asset Holding AB's liability under this agreement.

11. Protection against damage, theft and loss

All devices provided through Refurbly Flex are covered by the protection included in the Service, administered by Refurbly AB on behalf of Refurbly Asset Holding AB. For certain models, protection is provided through the Refurbly Care insurance in cooperation with Omocom, while for other models it is provided directly by Refurbly AB and/or Refurbly Asset Holding AB. The insurance applies as a supplement to this agreement and covers unforeseen events such as damage, theft or loss of the device occurring in the Nordic region, provided the agreement is active and all payments are up to date. During temporary stays in Europe (outside the Nordic region), equivalent protection may be provided directly by Refurbly and/or Refurbly Asset Holding AB even where external insurance is not applicable.Protection applies throughout the rental period and covers both damage and total loss of the device. If damage or loss is covered by protection, normally only a deductible of SEK 299 per claim is charged. The fee may be charged by Refurbly Asset Holding AB. However, protection does not apply to damage or loss caused by intent, gross negligence, fraud, embezzlement, force majeure or similar conduct. Minor cosmetic damage or normal wear is not covered.The customer must immediately report damage, theft or loss to Refurbly customer service. In case of theft, a police report must be filed without delay and no later than within 24 hours. A copy of the report must be provided to Refurbly and its insurance partner. If the customer does not fulfil these obligations, compensation may be denied and the customer will then be liable to pay the device's reasonable market price.For more information on the insurance coverage, exclusions and terms, please see Insurance Terms for Refurbly Care.

12. Refurbly Warranty

Refurbly AB provides and administers Refurbly Warranty for Devices rented out by Refurbly Asset Holding AB. All defects covered by Refurbly Warranty will be repaired by Refurbly. The warranty terms separately state in which situations Refurbly Warranty does not apply and which parts of a device are not covered by Refurbly Warranty.Refurbly Warranty applies continuously throughout the rental period.The warranty period for the phone battery is 12 months counted from the original rental date. You are entitled to a free battery replacement every 12 months provided battery health is below 80% at the time you contact Refurbly and the current battery is an original part from Refurbly. It is also required that no repair has been carried out by a third party during the rental period. You are obliged to familiarise yourself with these warranty terms for the device before you start using the mobile phone or tablet.You are responsible for all defects you yourself cause to the device. This may be, for example, causing physical damage to the device, not using the phone in accordance with instructions, or other negligent conduct. Note in particular the following:

  • A cracked or broken screen is not covered by Refurbly Warranty.
  • Software errors are not covered by Refurbly Warranty.
  • Removal of viruses or other malicious code from the device is not covered by Refurbly Warranty.
  • Damage to the device caused by failure to follow instructions and/or in connection with incorrect or unusual use of the device is not covered by Refurbly Warranty.
  • If you or a third party physically opens the device, Refurbly Warranty ceases to apply.
  • Damage to the device during transport due to negligence on your part is not covered by Refurbly Warranty. You are responsible for packing the device correctly for shipping.
  • Refurbly Warranty does not apply if the device's serial number or IMEI has been removed or otherwise made illegible.
  • Other indirect or purely economic damage caused by the device breaking down, such as destruction or corruption of data files, is not covered by Refurbly Warranty.
  • Refurbly Warranty does not apply if the phone's glass/home button/camera/other functions have broken due to, for example, incorrect and/or unusual use, e.g. if the device has been dropped or knocked against something.
  • Refurbly Warranty does not apply if a device rented from Refurbly has been repaired by the customer or a third party without Refurbly's written consent.
  • Refurbly Warranty does not apply if the device is deformed, has water damage or if any function has stopped working due to incorrect use, e.g. if the device has been dropped or knocked against something.
  • If you receive a replacement device, Refurbly Warranty continues to apply from the original rental date.
If an accident occurs that damages the device during the rental period, contact Refurbly support immediately for assistance via the protection included in Refurbly Flex. A replacement device may be sent and you pay only the deductible/claim fee.Refurbly Asset Holding AB and Refurbly AB reserve the right to charge an extra fee for delivery costs in cases where you were or should have been aware that the warranty had ceased to apply or if Find My iPhone (FMI) is enabled. In addition, Refurbly reserves the right to request photos of the phone before you send it in for warranty repair.

13. Lost or stolen phone

If the device is lost or stolen, you must immediately contact Refurbly AB's customer service. In case of theft, you must also file a police report as soon as possible and be able to present a copy of the report to Refurbly AB and Refurbly's insurance partner.Compensation and liability for costs in case of a lost or stolen device are governed by the protection included in Refurbly Flex and the terms stated in the section Obligations when returning the device. If the insurance does not apply, you may become liable to pay the device's reasonable market price.Refurbly Asset Holding AB and Refurbly AB reserve the right to report all lost and stolen devices to the authorities. These devices will be blacklisted and cannot be used further.

14. Limitation of liability

Nothing in these terms shall exclude or limit Refurbly's liability in matters where it would be unlawful for us to limit or exclude our liability.Refurbly Asset Holding AB is the contracting party and lessor under this agreement and is responsible for the obligations arising from the agreement and applicable law. Refurbly AB is only responsible for the services that Refurbly AB performs or administers on behalf of Refurbly Asset Holding AB, such as customer service, delivery, returns handling, warranty administration and other practical administration of the Service.Refurbly Asset Holding AB and Refurbly AB are not liable for indirect costs that are a side effect of the main loss or damage, e.g. loss of revenue or loss of business opportunities, or failure to deliver products or to fulfil any of our other obligations under these terms where such failure is due to an event beyond our reasonable control, including but not limited to fire, flood, storm, riot, civil unrest, war, nuclear accident, terrorist activity, strike, pandemic or quarantine. Refurbly Asset Holding AB's and Refurbly AB's maximum liability to you shall, to the extent permitted by mandatory law, be limited to the amount you have paid for the Service during the last 12 months.Product liability for defects is limited to any refund of the product purchase price minus benefits received.As the devices are used and refurbished, Refurbly does not provide original purchase receipts from the device's original owner and is not obliged to do so.Certain features or services available on the devices may require you to open an Apple ID or other account (e.g. a Google account). You are responsible for all activity that takes place on your account and for protecting your account information, including passwords. Refurbly cannot be held liable for loss or damage arising from failure to fulfil this responsibility. Refurbly is not responsible for forgotten Apple IDs, Google accounts or passwords.If the device is locked with an account or activation lock that prevents Refurbly from repairing, resetting or reusing it, the rules stated in the section Obligations when returning the device apply. This may mean that the device is sent back to you for a fee while the subscription continues to be charged, or that you are charged the device's reasonable market price if the device is no longer usable.

15. Changes to the terms

Refurbly Asset Holding AB reserves the right to change these terms. Information may be sent by Refurbly AB on behalf of Refurbly Asset Holding AB. You will be informed of any changes affecting your rights by email to the email address you have provided to Refurbly. If the changes are clearly to your advantage, Refurbly has no obligation to inform you specifically of these changes and the changes may take effect immediately.

16. Applicable law and dispute resolution

These terms are governed by Swedish law.If you have questions, complaints or wish to make a claim under this agreement, you should first contact Refurbly AB's customer service, which handles customer matters on behalf of Refurbly Asset Holding AB.If the dispute cannot be resolved through dialogue, you have the right to have the dispute examined by the National Board for Consumer Disputes (ARN). More information is available at arn.se.You may also use the EU platform for dispute resolution in cross-border consumer disputes.Disputes not examined by ARN or another competent authority shall be decided by a Swedish general court under Swedish law.
