The insurance is a voluntary group insurance covering purchase of property in accordance with the insurance terms below. Omocom, acting as group representative, has entered into a group agreement with the insurer W. R. Berkley Insurance AG, Swedish Branch, hereinafter referred to as Berkley. Through the group agreement, all Refurbly customers are group members and may choose to take out insurance in accordance with these insurance terms.

1. Who the insurance covers

The insurance applies to the insured person who purchases property stated on the insurance certificate.

2. When the insurance applies

The insurance applies to damage occurring while the insurance is in force (the insurance period). The insurance is in force for 1 year if the premium has been paid.

2.2 Renewal of the insurance contract

The insurance may be renewed for a further 1 year.

3. Where the insurance applies

The insurance applies to damage, theft or loss occurring in any Nordic country.

4. Sum insured

4.1 Compensation levels

When purchasing property, the insurance pays compensation up to the market value of the property before the damage occurred.

Maximum compensation is up to SEK 20,000.

5. Deductible

The deductible is SEK 299 for each claim.

6. What the insurance covers

The insurance covers mobile phones and accessories included in the packaging from Refurbly.

6.1 All-risk insurance

Compensation is paid for all-risk damage as stated in section 4.1. All-risk damage means sudden and unforeseen damage to or loss of property, as well as theft of property.

6.2 Deductible elimination

In cases where damage, loss or theft is covered by other insurance, this insurance pays compensation for the deductible deducted under the insured person's ordinary insurance, up to the maximum compensation level under section 4.1.

7. What the insurance does not cover

7.1 War, terrorism or riot

Compensation is not paid for damage whose occurrence or extent is directly or indirectly caused by or connected with war, warlike event, civil war, revolution, insurrection, riot, terrorism, sabotage or action by persons who have unlawfully seized power.

7.2 Causing damage

The insurance does not apply if the insured person has caused the damage intentionally or through gross negligence. The same applies if they must otherwise be assumed to have acted or failed to act knowing that this entailed a significant risk that the damage would occur.

7.3 Scratches and wear

Compensation is not paid for damage consisting of minor scratches or normal wear unless this affects the usability of the property.

7.4 Fraud, embezzlement or similar property offences

Compensation is not paid for damage caused by fraud, embezzlement or similar property offences.

7.5 Force majeure

The insurer is not liable for loss that may arise if claims investigation, payment of compensation or restoration of damaged property is delayed due to

• war, warlike event, civil war, revolution, insurrection or riot
• labour dispute
• confiscation or nationalisation
• requisition, destruction of or damage to property by order of government or authority.

The reservation regarding labour disputes also applies if the insurer has taken or is subject to industrial action.

7.6 Supplier warranty

The insurance does not apply to defects on items for which the supplier or another party is responsible under warranty, similar undertaking or strict liability under law. However, the insurance applies if the insured person can show that the responsible party disputes or is unable to fulfil their obligation.

7.7 Excluded property

The insurance does not cover pre-existing damage to property, whether or not the damage is visible.

8. Reporting a claim

Insurance claims must be reported to Omocom as soon as possible from when the insured person becomes aware of damage. Claims are submitted via the claims form enclosed when purchasing the insurance or directly to Omocom. In the event of damage, the insured person must submit:
• Completed claims form,
• copy of police report in case of theft or other crime,
• receipt for replaced or repaired property,
• copy of compensation decision from the insurer for ordinary insurance.

8.1 Cooperation in claims handling

You must cooperate to the fullest extent possible so that the claim can be resolved as quickly as possible. In particular, you must provide information that may be relevant to claims handling. You must especially answer questions posed by the claims handler. If the insurer suffers loss because you have not cooperated, your compensation will be reduced to what is reasonable under the circumstances.

8.2 How the claim is settled

Once you have reported the claim to us, we decide how the damage will be compensated. Compensation may be provided through repair, replacement or a gift card at Refurbly. Contact Refurbly for information about returning the product. We always have the right to take over property that we have compensated. We are responsible for the cost of damage after any depreciation.

8.3 Incorrect information in connection with a claim

If the insured person or anyone else claiming compensation after damage has intentionally or through gross negligence provided incorrect information, concealed or failed to disclose anything material to assessing the right to compensation under this insurance, compensation may be reduced or denied entirely.

9. Claims valuation rules

Omocom has the right to decide whether the product should be repaired, replaced with new property or compensated with a gift card. Repair or replacement with new property or compensation with a gift card shall be carried out via Refurbly's service workshop.

As owner of the property, you must, with our consent, order repair and approve or complain about work performed. The insurer takes ownership of all lost property that we have compensated.

9.1 Depreciation method

Damage or loss to property as stated in section 4.1 is valued at the cost of restoration based on the property's current value. Current value means the market value of the property at a given point in time.

Depreciation is always limited to a maximum of 80% of the new replacement value.

10. Limitation period

A person seeking insurance compensation or other insurance cover must bring legal action within ten years from when the damage was discovered. Otherwise, the right to compensation is lost.

If a person seeking insurance cover has submitted a claim to the insurance company within the time stated in the first paragraph, the deadline for bringing legal action is always at least six months from when the company has stated that it has taken a final position on the claim.

11. Right of subrogation

Upon payment of compensation for damage, the insurer assumes the insured person's right to claim compensation from any party liable to the insured person for the damage.

12. Disputes

Disputes regarding the interpretation and application of this insurance contract shall be tried by a Swedish court applying Swedish law.

13. Insurer

The insurer is W.R. Berkley Insurance AG, Swedish Branch, through Omocom as affiliated insurance intermediary.

14. Insurance Contracts Act

Otherwise, the provisions of the Insurance Contracts Act (SFS 2005:104) apply to this insurance.

Review of your case

If you are not satisfied with a decision in a case, you can always have the decision reviewed either by contacting Omocom to clarify any misunderstanding, or by writing to the complaints officer at the insurer (Berkley), describing the case and requesting a review. General court

An insurance dispute can in most cases also be tried by a general court.

17. Glossary – definitions

Voluntary group insurance – insurance that a member of a specific group has the right to join through notification/application.

Policyholder – the person who has entered into an insurance contract with the insurer.

Insurance contract – the contract applicable to each insurance and comprising the application to join the insurance, the insurance terms in force at any time, the latest insurance certificate, the Insurance Contracts Act (2005:104) and otherwise Swedish law.

Sum insured – the amount the policyholder is entitled to in the event of a claim.

Insurance certificate – the notice issued as soon as an insurance has been granted or amended, containing information on the scope and validity of the insurance, basic rights and obligations regarding the insurance, and important limitations of the insurance cover.

Insurance event – the event(s)/damage that may give rise to compensation under the insurance.

Insurer – the party that has entered into an insurance contract with the policyholder and is obliged to pay insurance compensation in accordance with the insurance contract, i.e. in this case W. R. Berkley Insurance AG, Swedish Branch, reg. no. 516410-2070 ("Berkley").

Insurance period – the period for which the insurance applies and for which the insurance premium has been paid.

Group representative – the party that has entered into the group agreement with the insurer, i.e. in this case Omocom.

Group agreement – the agreement between the insurer and the group representative governing what insurance cover group members may apply for. A valid group agreement is a prerequisite for entering into individual insurance contracts under these insurance terms.

Group member – a person belonging to a predefined group with the right to apply for insurance. In this case, the group consists of everyone who is a customer of the group representative, i.e. Omocom, provided the customer is permanently resident and registered in Sweden.

The insurance is activated upon payment of the insurance premium. For each krona paid in premium, an average of SEK 0.72 goes to Omocom, which handles all technical integration on the platform, design of the insurance, customer service and claims handling. The remaining SEK 0.38 goes to W.R. Berkley as the risk carrier.
